  1. About this Policy

    This privacy policy applies to all information collected or submitted when you install, access or use the 9tv application (“App”), whether through the mobile or desktop application and the website [insert URL] 9tv (“Site” and collectively with App “9tv”). By using 9tv, you consent to the processing of your information in accordance with this Policy.

    If we make material changes to this Policy that affect the way we collect, use and/or share your personal information, we will notify you by including an "Updated" label with the Policy on 9tv for 30 days after material changes.

  2. Information We Collect

    We have set out below the type of information we collect and how we collect it.

    • Registration Data. In order to create a user account and use 9tv, you will be required to provide a name, password and valid email address.
    • Additional Data. If you contact us through the contact us email, you may provide us with additional data. The information you provide is at your discretion.
    • Collection of Information from Use of 9tv. In addition to the information that you provide to us when you register for a user account, we collect the following information from your use of 9tv:
      • Your browser type, device type, time zone, language, and other information related to the manner in which you access 9tv.
      • Viewing History: Programs, channels, and content viewed, duration of viewing, search queries, and interactions such as pause, rewind, and fast-forward.
      • Device Identifiers: Unique identifiers associated with OTT devices (such as Smart TV model, device operating system, hardware ID, IP address, advertising ID).
      • Streaming Performance Data: Technical data on playback quality, buffering, latency, and crash reports.
      • Profile Information: If your 9tv account supports multiple user profiles (e.g., family profiles), we may associate viewing data with individual profiles.
    • We also collect information about your use of 9tv so that we can provide our services.
    • We do not retrieve data from your device other than as set forth herein.
  3. Use of Cookies and Analytics

    • In addition to cookies used on our website, OTT applications use: Device Identifiers (e.g., Roku ID, Apple IDFA, Fire TV ID).
    • In-App Tracking to measure viewing sessions and performance.
    • Advertising Identifiers (if targeted ads are enabled).

    You can usually reset or disable these identifiers via your OTT device’s settings.

  4. How we Use the Information We Collect

    We will only use the user Data collected about you or from your device for the purposes for which it is collected, as we explain below.

    1. Use of User Data Collected

      • Provide the Service: to open an account for you, enable you to access and stream 9tv content across devices, respond to your requests, and perform our agreement with you.
      • Internal Use: create reports for internal use to develop programs, products, services or content, and provide aggregated information on how visitors use 9tv, such as "traffic statistics" and "response rates," to third parties. Personalization: recommend programs and tailor content to your viewing preferences.
      • Content Licensing and Reporting: provide aggregated or anonymized viewing statistics to content licensors, rights-holders, and broadcasters, in order to meet contractual obligations.
      • Advertising and Marketing: if applicable, provide targeted advertising or recommendations, subject to your opt-in consent where required by law.
      • Analytics and Improvement: measure audience size, improve streaming quality, and enhance the user experience.
      • Safety, Security, and Integrity: we use information we have to verify accounts and activity.
    2. Legal basis for processing personal data

      We process personal data for the purposes set out in this Policy, as described above. We will only collect, process or share your personal data if we are satisfied that we have an appropriate legal basis to do this. Our processing is necessary for the purposes of legitimate interests pursued by us in order to: (i) perform our agreement with you; (ii) to evaluate, develop and improve 9tv and other products; (iii) to prevent fraud; (iv) to protect our business interests; and (v) to ensure complaints are investigated. It may be necessary to process your personal data to comply with a legal obligation.

      We may also use your personal data for purposes that are compatible with the purposes we have described to you including archiving purposes in the public interest, scientific research or statistical purposes, if permitted by data protection laws.

      Where we have no other valid legal basis to process personal data, it will be processed based on your consent, which may subsequently be withdrawn at any time by contacting us through the “Contact Us” tab on 9tv. Withdrawal of your consent will not affect the lawfulness of processing based on consent before its withdrawal, or processing that is being done on the basis of other lawful grounds. If targeted ads are shown, you must use opt-in consent.

  5. Your rights under local laws

    Subject to certain exemptions, and in some cases dependent upon the processing activity we are undertaking, you may have, under certain applicable laws, some or all of the following rights in respect to your Personal Information.

    • Right of Access: the right to be informed of and request access to the personal data we process about you;
    • Right to Rectification: the right to request that we amend or update your personal data where it is inaccurate or incomplete;
    • Right to Erasure: the right to request that we delete your personal data where: (i) it is no longer needed for the purposes for which it was collected; or (ii) you have withdrawn your consent (where the processing of your personal data was based on consent); (iii) you have successfully objected (see right to object below); (iv) it has been processed unlawfully. We are not required to comply with your request to erase personal data if the processing of it is necessary for compliance with a legal obligation or for the establishment, exercise or defense of legal claims.
    • Right to Restrict: the right to request that we temporarily or permanently stop processing all or some of your personal data;
    • Right to Object: the right to object to your personal data being processed for direct marketing purposes and the right, at any time, to object to us processing your personal data which has our legitimate interests as its legal basis if you believe your fundamental rights and freedoms outweigh our legitimate interests. If you raise an objection, we have an opportunity to demonstrate that we have compelling legitimate interests which override your rights and freedom;
    • Right to Data Portability: the right to request a copy of your personal data in electronic format and the right to transmit that personal data for use in another party’s service; the right to request a copy of your personal data in a structured, commonly used, machine-readable format, and the right to request that we transfer it directly to another data controller, but in each case only where: (i) the processing is based on your consent or on the performance of a contract with you; and (ii) the processing is carried out by automated means.
    • Right not to be subject to Automated Decision-making: the right to not be subject to a decision based solely on automated decision making, including profiling, where the decision would have a legal effect on you or produce a similarly significant effect.

    If you wish to issue a request to exercise your rights where applicable by law (whether located in the EU or elsewhere), please contact us on the Contact Us tab on 9tv. Please provide your name and contact information along with the request. When we receive a request to exercise one of these rights, we will indicate what personal information we require from you to validate your identity. We will also provide information on the action we intend to take on the request without undue delay. Please note, these requests are subject to applicable legal or document retention obligations imposed on us.

  6. Sharing your personal data

    We do not share, sell, or otherwise disclose your personal data for purposes other than those outlined in this Policy. However, we may disclose personal data that we collect from you or that you provided to us to the following recipients for the purposes described below:

    • To contractors, service providers, and other third parties we use to support our activities and who are bound by contractual obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them, such as persons who perform maintenance on our computer systems, companies that assist us in processing transactions, technology and analytics providers (e.g., streaming analytics companies, CDNs) or content licensors and broadcasters (for reporting on audience engagement).
    • We may also share your personal information with a potential buyer of 9tv or in connection with (a) the sale, assignment, or other transfer of our business (or significant part thereof), in which case we will require any such buyer to agree to treat it in accordance with applicable data protection legislation; or when required by applicable laws, court orders, or government regulations.
    • We may also share tracking information with our marketing and advertising partners (only with your consent, where required).

    We take proper steps to ensure that recipients of your personal data are bound to duties of confidentiality and we implement data protection contractual clauses (to the extent required) to ensure that any transferred Personal Data remains protected and secure.

  7. Data Retention

    • Registration Data: In order for you to continue to use 9tv, we will retain the registration data that you have provided to us. You control when such information is deleted. If you enter the “Delete Account” tab on the Application, this will delete the information that you provided to us for registration, including any images provided for the profile picture. If you, however, delete the Application from your device, without entering “Delete Account”, we do not know that you have deleted your account, and the information that you provided to us will not be deleted.
    • Viewing History: Retained for [12–24 months] unless you request earlier deletion. After this period, data may be anonymized and used for statistical purposes.
    • Aggregated Audience Data: Retained indefinitely, but without identifiers that can link back to individual users.
  8. Minors

    • 9tv is not directed at children under the age of 13, or another age if required by applicable law.
    • Where a child profile is created by a parent or guardian for use of 9tv, limited personal data (such as age range or viewing history) may be collected.
    • We require verifiable parental consent before processing a child’s personal data.
    • Parents may request deletion of a child’s data at any time via the “Contact Us” tab.
  9. Links to Third Party Sites

    At this point, we would also like to remind you we may provide additional links to resources we think you will find useful. These links will lead you to sites that are not affiliated with 9tv and may operate under different privacy practices. You are responsible for reviewing the privacy policies for such other websites, as we have no control over information that is submitted to other sites.

  10. Transfers of Data to a Different Geographic Region

    Our Company is incorporated in Israel. We use service providers whose computers and servers may be in various countries. Your information might end up on one of those computers in another country, and that country may have a different level of data protection regulation than the protection in the country in which you are located. By giving us information, you consent to this kind of transfer of your information. No matter what country your information is in, we comply with the law applicable to us and will also abide by the commitments we make in this privacy policy.

  11. Security

    We have agreements with third parties and have adopted other security measures in place to protect against the loss, misuse and/or unauthorized alteration of the information under our control or under the control of our service providers. Your personally identifiable information is protected by utilizing both online and offline security methods, including firewalls, passwords and restricted physical access to the places where your information is stored. Although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information will always remain free from security issues. In the event of a security breach involving your personal information, we will make any legally required disclosures to you in the most expedient time possible and without unreasonable delay, consistent with the legitimate interests of law enforcement, or any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

  12. Credit Card Information

    Your credit card details are only stored and transmitted in encrypted form. Unencrypted credit card information is not stored on our internet servers. Online credit card payments are currently processed using a third party payment gateway service. Credit card information is never stored in a cookie.
